摘要:
全面回顾近10年来国家、省和地方历史文化名城保护的立法进程，分析国家和地方保护法规的整体格局、基本特征以及面临的主要问题和挑战。对国家建成遗产保护立法、保护传承机制完善策略等方面提出了若干建议，认为国家法律是实现将城乡历史文化保护传承作为基本国策的制度保障，应当通过保护立法将“保护优先”落实到绿色发展、空间规划、资源管理、文化复兴和城市更新等环节；通过保护法制建设，促进建成遗产的积极保护传承、可持续利用和民生福祉改善；通过提升遗产保护管理的质量，为生态文明和美丽中国建设作出积极贡献；通过依法开展的公众参与程序，确保遗产保护实践成果惠及广大人民群众。
Abstract:
Based on comprehensive review of the legistative process of the conservation for the Historic and Cultural cities at national, provincial and local levels since 2010 and analysis of the general layout, basic characteristics, main problems and challenges faced by national regulations, this paper puts forward several suggestions of protection legislation and system improvement strategy for the national heritage conservation and inheritance mechanism. It is believed that the national law is the institutional guarantee for realizing the urban conservation and cultural inheritance as the basic national policy, and the conservation priority should be implemented into green development, spatial planning, resource management, cultural rejuvenation and urban regeneration through legal system. The active conservation, sustainable utilization and improvement of people’s livelihood of built heritage should be promoted through the legal system.Positive contributions will be made to ecological civilization and the construction of a beautiful China by improving the quality of heritage management; Through the public participation procedure carried out in accordance with the law, the achievements of heritage conservation practice will benefit the broad masses of the people.
