摘要:
历史街区的活态保护与有机更新,是完善城乡历史文化保护传承体系的关键举措。然而,历史街区中错综复杂的产权关系往往使相关实践面临诸多挑战。历史街区的产权特性与传统更新模式之间的结构性冲突,导致市场效率失灵、社会网络瓦解及对价机制缺失等困境。基于此,提出了“产权柔性重构”这一理论新视角。该视角的核心是在不改变“所有权”的前提下,通过对“使用权”等权能的动态分离与重组,建立一种能够聚合多元主体的产权契约机制,并以此作为建构社区认同的根基。研究提炼了基于使用权的柔性重构形式及社区共同体的生成过程,并以扬州仁丰里历史文化街区的“收储租”模式为实证,印证了产权柔性重构不仅能降低交易成本、维系社会网络,而且是推动历史文化保护传承体系从“空间管控”迈向“活力再生”的重要治理工具。
Abstract:
The living conservation and organic renewal of historic districts are pivotal measures in refining the urban-rural historical and cultural preservation system. However, the intricate property rights relations within historic districts often pose numerous challenges to implementation. This paper provides an in-depth analysis of the structural conflicts between the property rights characteristics of historic districts and traditional renewal models, summarizing a triple predicament characterized by market inefficiency, the disintegration of social networks, and the absence of compensation mechanisms. Building on this, the paper proposes the novel theoretical perspective of flexible restructuring of property rights. The core of this perspective involves establishing a property rights contractual mechanism that aggregates diverse stakeholders through the dynamic separation and reorganization of usage rights and other entitlements, without altering ownership, thereby serving as the foundation for constructing community identity. This study elucidates the classic forms of flexible property rights restructuring and the generative process of diverse community networks, providing an empirical analysis using the "acquisition-holding-leasing" model of the Renfengli Historic and Cultural District in Yangzhou. The findings indicate that flexible property rights restructuring not only reduces transaction costs and sustains social capital but also serves as a crucial governance tool for propelling the historical and cultural preservation system from "spatial control" towards "vitality continuity."
