摘要:
采用调查研究和比较分析相结合的方法,梳理江苏宅改试点地区资格权认定及实现的主要影响因素并提出解决思路。研究发现:江苏宅改试点地区在资格权认定和实现过程中主要存在集体经济组织成员身份认定工作不扎实、准确把控资格权人信息较为困难,资格权实现方式单一,兑现难等现实问题,影响了资格权试点工作的进一步深入开展。研究结论:要加强顶层设计,资格权的试点改革应与宅基地所有权和使用权的改革协同推进。严格落实宅基地资格权认定工作。允许宅基地向社会流转,尝试按年收取房地产使用费,让农民获取资产收益。构建三方合作体系,保护农民的合法生活居住权益,促进社会和谐,共同富裕。
Abstract:
This article compares the policies and makes investigation to pilot areas in Jiangsu in order to find out the main factors that affect the identification and realization of qualification right of homestead.The results of the research shows that the problems about the experiments in the qualification right of homestead including the low quality of work during the investigation of farmers, making it difficult to certify the information of different peiple. Meanwhile, there are’t any different methods to fulfill and compensate the loss of homestead during the identification of the qualification right of homestead. These problems deeply hinder the achievement of the qualification right of homestead. The conclusions of the research are as follows. Firstly, the government should enhance top-level design and push forward qualification right reform together with property right reform and ownership reform. Secondly, the qualification right pilot can improve the process of qualification right certification, Finally, it is necessary to establish an alliance of county-level or city-level collective economic organizations, explore new ways to cash and withdraw qualification rights, and collect real estate fees annually to help promote common prosperity.
